New Civil and Administrative Cassation Appeal Procedures in Kazakhstan
The new Civil and Administrative Cassation Appeal Procedures, which came into effect in Kazakhstan on July 1, 2025, introduced significant changes to how appeals are handled in civil and administrative cases.
Thus, starting from July 1, 2025, new civil and administrative cassation courts (based in Astana, Kazakhstan) will start handling all cassation appeals against final judgments in civil and administrative cases.
With effect from July 1, 2025, any civil and administrative cassation appeals must be filed with civil or administrative cassation courts, respectively.
Rulings of such cassation courts may be reviewed by the Kazakhstan Supreme Court on an exclusive basis upon (i) recommendation of a judge of the Kazakhstan Supreme Court and (or) (ii) a protest of the Kazakhstan Prosecutor General.
The cassation appeals (motions) filed with the Kazakhstan Supreme Court prior to July 1, 2025, which have not been adjudicated yet, will be automatically forwarded by the Kazakhstan Supreme Court to the newly set up cassation courts.
