Amir Begdesenov, Senior Associate of Sayat Zholshy & Partners, took part in Business & Antitrust Regulation Workshop

On 7 March 2013, Holiday Inn Almaty hosted Business & Antitrust Regulation Workshop organized by VIPromotion where Amir Begdesenov made three presentations.

The first presentation was devoted to anticompetitive agreements and concerted practices where Amir focused on the key issues of horizontal and vertical agreements, the necessary evidence of anticompetitive agreements and concerted practices.  This presentation also touched upon certain exceptions from the general prohibition on anticompetitive agreements and concerted practices.  The presentation involved case studies and panel discussion of unfair competition where the participants talked about the term “unfair competition” (the difference between antitrust and civil legislation) and its distinction from prohibited monopolistic activities.

In his second presentation Amir spoke about the sanctions for antitrust offences.  Amir addressed the most vital practical issues of such sanctions application.  The participants learnt how to calculate and apply penalties and how transactions are invalidated on the grounds of antitrust offence.

The third presentation of Amir Begdesenov was devoted to the issues of antitrust investigations performed by the Kazakhstan antitrust authorities.  The presentation focused on such issues as general regulation, the difference between investigations performed by antitrust authorities and investigations performed by other government authorities, the powers of antitrust authorities, the grounds for investigation, procedural issues, as well as the contents and list of documents required by antitrust authorities, and entity’s actions undertaken before, in the course and after investigation.

The event was also attended by Salans’ experts – Senior Associate Yelena Maximenko and Associate Akylbek Kussainov.
