Amendments to the Kazakhstan Procurement Regulations in Mining Sector

Pursuant to Joint Order of the Kazakhstan Minister of Investments and Development No. 139 of 30 January 2016 and of the Kazakhstan Minister of Energy No. 85 of 23 February 2016, Joint Order of the Kazakhstan Minister of Investments and Development No. 253 of 27 February 2015 and of the Kazakhstan Minister of Energy No. 241 of 27 March 2015 titled “On Approval of the Regulations for Procurement of Goods/Works/Services in the Mining Sector” (the “Regulations”) underwent certain amendments mainly in relation to the support and preference of domestic producers/providers and the increase of domestic content in procured goods/works/services, as well as tender procedures, in particular, the contract award procedure.

For example, Section 85 of the Regulations provides that in case of an open tender where bids offer the same price the preference shall be given to the Kazakhstan producer/provider, subject to conditional price reduction.
