Sayat Zholshy & Partners has recently published an analytical report prepared by the firm’s Senior Partner Aidyn Bikebayev titled The Analysis of the Current Legal Regulation of the Antitrust (Competition) Policy and Its Practical Implementation: Recommendations for Improvement.

This report is recommended for publication by the Academic Council of the Economical Research Institute of the Ministry of Economic Development and Trade of the Republic of Kazakhstan.

The monograph was reviewed by Zh.K. Bopieva, Acting President of the Economic Research Institute, Doctor of Economics, Member of the Russian Academy of Natural Sciences and Sh.Sh. Zhakupova, Director of the Strategic Development and Economic Research Center of the Economic Research Institute, Doctor of Economics, Associate Professor.

The report contains specific recommendations for improvement of Kazakh antitrust (competitive) legislation which are based on its analysis and comparison with the laws and law enforcement practices in other countries.

The Report consists of 5 sections dealing with main sets of problems that exist in the current antitrust (competitive) laws. Each section consists of several chapters (27 in total) and each chapter covers one or more specific problems and offers clear recommendations for their resolution.

The first section aims to prove the fallacy of the conceptual notion of protection of consumers’ rights which is employed by the government’s competition authority.

The second section recommends to cancel and improve some regulations that unreasonably limit freedom of enterprise.

The third section recommends new ways for increasing efficiency of the work aimed to prevent actions of government authorities restraining competition.

The forth section recommends to cancel and improve a number of statutory provisions that decrease the efficiency of control of market participants’ monopolistic practices.

The fifth section recommends to completely change the unfair competition laws and regulations. This recommendation is based on the conclusion that the main reason for the lack of efficiency in this area is the weak and contradictory legal and regulatory framework.
